1. About Our Services

NU-U Health & Fitness provides fitness and wellness coaching, instruction, and education โ€” not medical care. Founded in 2008 by Elena Tonietto, a fitness professional with 20+ years of experience, we offer in-person services in North Bay and the Nipissing District, and online services for clients across Canada and the USA. Our offerings include a full range of programs such as Pilates, personal training, functional strength and mobility, posture, balance and core work, healthy aging, nutrition coaching, weight-loss coaching, outdoor fitness, sylvotherapy (forest therapy), workshops, and signature group programs. 2. Important Health Disclaimer โ€” Please Read

Our services are coaching and educational in nature and are not a substitute for professional medical advice, diagnosis, or treatment. Elena Tonietto and NU-U Health & Fitness do not diagnose, treat, or cure any medical condition, and nothing we provide should be interpreted as medical, clinical, or personalized health advice. We make no guarantee of any specific fitness, wellness, weight, or health outcome.

  • Consult your physician first. You should consult your physician or qualified healthcare provider before beginning any new exercise, nutrition, or wellness program, particularly if you are pregnant, have a chronic condition, an injury, or any concern about your ability to exercise safely.
  • Complete a readiness questionnaire. Before starting, you agree to complete a PAR-Q+ (Physical Activity Readiness Questionnaire) and to disclose any relevant health information honestly and completely so we can support you responsibly.
  • Participate at your own risk. Physical activity carries an inherent risk of injury. By participating, you acknowledge these risks and voluntarily assume them.
  • Assumption of risk & voluntary waiver. You participate of your own free will, accept full responsibility for your own health and safety, and agree to stop and seek medical attention if you experience pain, dizziness, or discomfort.

Signing a separate waiver and assumption-of-risk form may be required before your first session.

3. Bookings & Scheduling

Sessions, classes, and programs are booked in advance through the method we agree on โ€” online booking, phone, email, or WhatsApp. Bookings are confirmed once you receive confirmation from us and, where applicable, payment is received. Spaces in classes, group programs, and retreats are limited and offered on a first-come basis. Please arrive on time; sessions begin and end as scheduled, and time lost to a late arrival cannot always be recovered. 4. Payments & Pricing

All prices are quoted in Canadian dollars (CAD). Clients based in the USA who use our online services may be invoiced in US dollars (USD) where indicated. Payment is due at the time of booking or as otherwise agreed for packages, memberships, and programs. Package sessions, class passes, and prepaid programs are valid for the period stated at purchase. Prices, packages, and program details are subject to change at any time; changes will not affect services you have already paid for. Any applicable taxes are added where required by law. If a payment is declined or outstanding, we may pause services until it is resolved.

5. Cancellation & Refunds

We ask for at least 24 hours’ notice to cancel or reschedule a one-on-one session. Sessions cancelled with less notice, or missed without notice (“no-shows”), may be charged in full or deducted from your package. For group programs, retreats, and workshops, specific cancellation windows and deposit terms are provided at the time of booking.

Your rights are protected under the Ontario Consumer Protection Act, 2002. Where that Act applies, you may cancel an eligible prepaid or future-performance services agreement and receive a refund as provided by law โ€” including the statutory 10-day cooling-off period for certain agreements, during which you may cancel for any reason and receive a refund of amounts paid, less the value of any services already provided. To cancel, notify us in writing at elenafit4u@gmail.com. Refunds for unused prepaid services are calculated on a fair, pro-rated basis. Nothing in these Terms limits any right or remedy you have under the Ontario Consumer Protection Act, 2002.

6. PRYSM iO Antioxidant Scan Disclaimer

NU-U may offer an antioxidant assessment using the PRYSM iO scanner as part of our wellness services. This scan is a general wellness and educational tool only. It is not a medical test, diagnosis, or screening, and its results are not intended to diagnose, treat, cure, or prevent any disease or medical condition. The reading provides a general indicator to support lifestyle and nutrition coaching conversations โ€” it does not replace bloodwork, laboratory testing, or the advice of your physician. You should not make any medical or treatment decision based on a scan result. Always consult your healthcare provider regarding your health.

7. Intellectual Property

All content, materials, programs, choreography, branding, and methods created by Elena Tonietto and NU-U Health & Fitness โ€” including the signature NU Women Level Up and Health Warrior programs and the NU Bar choreographed weighted-bar training method โ€” are the intellectual property of NU-U Health & Fitness and are protected by copyright and other laws. These materials are provided for your personal, non-commercial use as a client only. You may not copy, record, reproduce, teach, resell, or distribute our programs, class content, videos, handouts, or the NU Bar method without our prior written permission. The NU-U name and related program names are our trademarks and may not be used without consent.”}

8. Limitation of Liability & Release

To the fullest extent permitted by law, Elena Tonietto and NU-U Health & Fitness are not liable for any injury, loss, or damage โ€” direct, indirect, incidental, or consequential โ€” arising from your participation in or use of our services, except where such liability cannot be excluded by law. You participate voluntarily and at your own risk, and you release NU-U from claims arising out of your participation, to the extent permitted by law. Our total liability for any claim relating to the services will not exceed the amount you paid for the specific service giving rise to the claim. This section does not limit your rights under the Ontario Consumer Protection Act, 2002, or any other rights that cannot be waived by law, and nothing in these Terms excludes liability for gross negligence or wilful misconduct where such exclusion is prohibited.

10. Governing Law & Contact

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, and any disputes will be subject to the courts of Ontario.
